The government had on June 26, 2013 issued a directive to Brihanmumbai Municipal Corporation (BMC) as well as other city corporations and councils, to include a column in death certificates and application forms, which would help people consider giving consent to donating their

seeking alteration to section 6 of the Transplantation of Human Organs Act to facilitate retrieval of corneas in medico-legal cases without any additional legal hassle.

Jaswant Mehta, chairman, Eye Bank Coordination & Research Centre, informed the court that after going a lot back and forth, only the BMC has included the column but other city corporation had not.

The bench also came down heavily on the government for the advisory committee, formed after a government resolution was passed in 2012, not having met met thereafter.

Additional government pleader Niranjan Pandit however claimed that the committee had met in March 2012 even before the resolution to constitute it had been issued. The bench was irate on hearing this, and asked: “How can that be possible? Can the committee meet even before it is constituted. Can you argue as a government pleader if you have not been appointed?
